The City of Austin Development Services Department (DSD) is working with stakeholders to develop a contractor registration program. This page includes information about what is under consideration and will continue to be updated throughout the life of the project. Please continue to check this site for updates. Background

In response to feedback received during a previous engagement on the demolition process, the Austin City Council approved Resolution No. 20201001-011, initiating amendments to the Land Development Code to establish a contractor registration program. The resolution directed the City Manager to engage stakeholders to evaluate specific requirements, including but not limited to bonding and insurance, equity metrics, incentives, and exemptions.


Stakeholder Feedback

Formal stakeholder engagement was completed on August 20, 2021. Feedback collected during the virtual engagements as well as responses to the questions and comments received on SpeakUp during the engagement period can be found in the "Documents" section. You can also read more about the previous demolition engagement series by visiting the SpeakUp page for the Demolition Permit Process.

While the formal engagement period is closed, DSD is working closely with local community groups to collect additional feedback and refine the final staff recommendations based on stakeholder input.

Next Steps

We appreciate your interest in the contractor registration program. DSD staff has reviewed the input received from stakeholders and is looking for opportunities to scale the proposed program in response to stakeholder feedback. DSD also has been briefing City boards, commissions, and committees throughout the engagement process.

As of early November 2021, DSD is working with the Council Housing and Planning Committee to schedule a committee briefing. Guidance received will help determine next steps and final recommendations to the Austin City Council.

    What amount of insurance and bonding is reasonable?


    Definitions
    Insurance: 
    Protects against losses and lawsuits in case of unforeseen circumstances.
    Bonding: 
    Protects against disruptions or financial loss due to a contractor’s failure to complete a project or meet contract specifications


    Current staff considerations include:

    1. Annual $10,000 bond
    2. Certificate of Liability Insurance with the City listed as the Certificate Holder:
      • Public liability (bodily injury) insurance with limits not less than $300,000 for each occurrence.
      • Public liability (property damage) insurance with limits of not less than $100,000 for each accident and $200,000 in the aggregate.
      • Must also provide proof of Workers’ Compensation in accordance with statutory requirements.

    1. What can we measure to demonstrate equitable outcomes?

    2. What is an appropriate response to contractors who are unable to comply with program requirements?


    Current staff considerations include:

    1. Track impact of requirements to small, women-owned, or minority-owned businesses.
    2. Actions taken in the event of non-compliance may include:
      • Notification of offense, with 3 months to resolve
      • 6-month period for first-time suspension 
      • 12-month period for all suspensions after first

    1. Registration only consists of contact information (including Texas license, if applicable).
    2. Exemptions should not threaten or circumvent health and safety concerns.
      Homeowners working with Homestead Permit may be exempt.
