BACKGROUND

Development along the East 11th and 12th Street corridor (see map above) is regulated by the Urban Renewal Plan (URP) and two Neighborhood Conservation Combining Districts (NCCDs). Beginning in late 2018 Austin’s Urban Renewal Board (URB) began the process of reviewing and making recommendations to update the URP which was adopted in 1999 and since amended 11 times. In addition to updating the URP, the Board also recommended changes to the East 11th Street and East 12th Street NCCDs. A NCCD is a zoning overlay that can be customized to serve goals such as revitalizing and preserving parts of an area. On February 8, 2021, the URB officially recommended their changes to the URP and the NCCDs. The board went to great lengths to ensure that the plan and the NCCDs were in alignment.

Although Chapter 374 of the Texas Local Government Code allows an urban renewal plan to supersede local zoning regulations, it has been the City of Austin’s practice to ensure that the URP and the NCCDs for East 11th and East 12th Streets be in alignment. The URP is set to expire in 2028 and can be evaluated in 2023 to determine if there is a continued need for the plan. In the event that the URP is no longer in effect, the NCCDs would be the applicable regulations.


NEXT STEPS

The next steps in this process are a virtual public meeting on April 20, 2021 for interested parties to learn more about the Board’s recommended changes and ask questions. Comments received at this meeting will be compiled, posted online, and included in staff reports. Any emails received and comment made on this SpeakUp Austin! web page will also be included. Following this meeting, the plan and NCCDs will go before the Planning Commission on June 22 and City Council on September 1. At those meetings, people will be able to provide feedback on the recommended changes.

    Before development can proceed in areas covered by these corridors a staff determination is required. This determination establishes at what height above sea level the corridor exists in space and how wide it is. This analysis establishes the maximum height of a building under that corridor and where on a project site the corridor will affect the envelope of a proposed building.

    After further review, staff has determined that the creation of Subdistrict 4 would create nonconforming uses and a reduction in entitlements for some properties. Staff is recommending that properties within the proposed Subdistrict 4 retain their current Subdistrict 1 and 2 designation.     No, there will be not FAR maximum in the East 12th Street NCCD. Building size will be controlled by height, setback, and impervious cover standards.
