The Development Services Department (DSD) is proposing adoption of several amendments to the Building Criteria Manual (BCM) in the 4th quarter of 2021. The proposed amendments will expand and improve the Change-Out Program for timed inspections. This program provides a time-specific inspection as an alternative to traditional inspections. The proposed changes for the Change-Out Program will:
Update the program to be more expansive, applying to a greater variety of inspections.
Formalize the language for the program, moving it from a memorandum into the Building Criteria Manual.
Update the language in program documents to reflect the program's expansion.
Enacting these changes will allow more people to benefit from the popular program. At the present time, only replacement of residential HVAC and water heater inspections qualify for Change-Out Program timed inspections. Once the proposed changes are implemented, residential inspections that qualify will include replacement of windows, siding, roofing, and more. Also, some commercial inspections will be eligible for the program.

At this time the program is not for all inspections. There are many different disciplines that require inspections and will not qualify for this program. We will take your feedback into consideration as this program grows. Thank you for your input.

Initiating department prepares new rule by working with the City of Austin Law Department along with other City of Austin departments that may be affected by the new rule. External meeting begin for input about the proposed Rule changes.
Interdepartmental Review

Department Rules Single Point of Contact submits required documents for publishing and notifies all City of Austin Departmental Single Points of Contact. Interdepartmental review begins.
Notice of Proposed Rule

The Land Development Rules Manager submits required documents to City Clerk for Official Posting. Formal public comment process begins. Contact information for submitting comments to the appropriate department contact will be announced. If you missed the opportunity to interact during the "Develop Rules" stage in July, this step will be your next opportunity to provide input. The Notice of Proposed Rule will begin on October 6, 2021.
Notice of Rule Adoption

The formal notice is posted with the City Clerk, including the final rule language and effective date. This notice identifies if any changes were made to the text of the rule from what was proposed and posted previously in the process.

A 30-day period for final appeal begins to receive final appeals before the rule is published.
Publishing

The final rule language is sent for publishing. This language includes the rule number, specific criteria manual being updated, date of adoption and effective date to MuniCode. This will be published on the website and included in the next quarterly update of the hard copy criteria manuals.
